Terms and Conditions for Bidding and Buying on Breaqs.com
We want Breaqs.com to be a safe, transparent and enjoyable platform for everyone. Please take a moment to read these terms and conditions before you bid or buy an item. They explain your rights, responsibilities and the limits of our role as a platform.
1. Platform Role and Liability
Breaqs.com acts solely as an intermediary between buyers and sellers. We do not own, sell, inspect, store or guarantee the items listed on our platform. All transactions are made directly between buyers and sellers.
While we strive to provide a safe environment, Breaqs.com does not verify the accuracy, legality or quality of listings. Therefore, we cannot be held liable - directly or indirectly - for any of these:

The condition, legality or authenticity of any item.

The accuracy or completeness of any item description.

Any damage, dispute or loss arising from the use of the platform or any transaction.
Please always check listings carefully and contact sellers if you have any questions before bidding or buying.
2. Binding Bids
All bids placed on Breaqs.com are legally binding. If you are the highest bidder at the end of the auction, you are obliged to complete the purchase for the final bid amount.
By placing a bid you agree to this:

Pay the total amount (including any buyer fees, shipping and taxes, if applicable).

Pay the invoice within the specified time.

Comply with these terms and conditions.
Failure to pay will result in an administration fee of €50 and a penalty of 20% of the invoice amount. Non-compliance may also result in suspension or permanent exclusion from our platform.
3. All Sales Are Final
Once an auction has ended and you've won, the sale is final. Cancellations will not be accepted unless both parties (buyer and seller) agree.
Note: If you are buying from a private individual, returns are generally not accepted unless the item has been significantly misrepresented.
4. Confirming High Bids – Important Notice
To prevent accidental overbidding, Breaqs.com will display a confirmation popup if you place a bid that is significantly higher than the current highest bid. Typically, this applies to bids that are either € 500.- or 20% higher than the current amount/bid.
⚠️ Important for last-second bidders:
As this confirmation popup requires your action before the bid is placed, placing a high bid at the last second may cause you to miss the auction due to the time it takes to confirm.
Please note, however, that there is no need to rush your bid in the final seconds. Auctions on Breaqs.com are automatically extended by 60 seconds if a new bid is placed in the last 30 seconds. This ensures that everyone has a fair chance to respond and discourages sniping.
5. Auction Extensions
Please note that auction end times are dynamic. If a bid is placed in the last 30 seconds, the auction will be extended by 60 seconds. This process will continue until no new bids are placed, ensuring fair bidding.
6. Disputes and Item Issues
If the item you have received is not as described, you may be able to open a case. Here's what you need to do:

Compare the item with the listing and take note of any differences.

Contact us within 3 days of delivery to suspend the seller's payment.

Submit clear photos of:

The full item and its flaws.

The packaging and shipping label, or in the case of larger transport items, how it was delivered.

A short video if the problem is functional or not easily visible.

Describe in detail what is different from the original description.

Reach out to the seller to see if a solution can be agreed upon.

Our team will review and advise you on the next steps.
If we don't receive a complaint within 3 days of delivery, we will assume the item is satisfactory and release payment to the seller. Complaints made after this period are less likely to be resolved in your favour.
7. Return and Refund Policy
Returns are generally not accepted, unless:

The seller agrees.

The item has been grossly misrepresented.

Applicable consumer protection laws require it (typically for professional sellers).
We do not guarantee refunds unless a dispute is resolved through our dispute resolution system. Always retain the original packaging in the event of a return.
Returns and refunds will not be accepted:

Buyer's remorse or cancellations after bidding.

Items not allowed by the platform rules.

Items clearly marked as damaged, incomplete or for parts.

Minor cosmetic issues not mentioned in the description.

Used or modified items after delivery.

Items missing non-critical accessories (e.g. screws, buttons).

Packaging damage where the product itself is intact.

Exchanges initiated by the buyer without agreement.
8. Buyer Protection and Mediation
In the event of unresolved issues, Breaqs.com may assist with mediation through our internal support system. Complaints must be submitted through the official support channel to be considered.
9. Payment Methods and Responsibilities
If you win an auction on Breaqs.com, payment must be completed within 3 working days. The way the seller chooses to receive payment will affect how this process works:

If the seller accepts full payment through our platform: You must pay the full purchase price, including auction fees and VAT on the commission, directly to Breaqs.com within 3 working days.

If the seller opts for "Buyer pays directly upon pickup": You are still required to pay the commission and VAT to Breaqs.com within 3 business days of the auction ending.
Once your payment has been processed, you'll be able to contact the seller directly via our chat system to arrange collection or delivery. If shipping is required, our support team can assist you. [Click here for more information.]
Note: The final amount due consists of the winning bid + commission + VAT (based on your local rate). For example, in the Netherlands, VAT is charged at 21% on the commission.
10. Account Verification Requirements
To place bids on Breaqs.com, your account must be verified. This is to ensure a safe and trustworthy environment for all users.

You will need to verify your bank account by depositing a small amount (usually €1).

In some cases, we may also require a one-time SMS verification of your mobile number.
Unverified users cannot participate in live auctions or place bids.
11. Reporting Fake or Fraudulent Listings
We work hard to keep Breaqs.com safe for buyers and sellers. If you come across a suspicious or fraudulent listing, please help us by using the "Flag this listing" button available on every item page.
Our moderation team will promptly review the report and take appropriate action, which may include removing the listing and suspending the seller's account.
